The terms of the data services.
These terms cover DAP Bellwether, the Compute Market Tracker endpoints and DAP Foundry, when reached by API, MCP or x402. They are operated by Dartmouth Advisory Partners Inc., Toronto, Canada. Questions: info@dap.solutions.
ACCEPTANCEUsing a service means you accept.
You accept these terms when you, or software acting for you, call a service, send a payment or use a licence key.
If software calls a service for you, you are responsible for what it does. If you act for an organization, you accept for that organization.
A signed licence with DAP takes priority where it differs from these terms.
THE SERVICESPublic information and calculations.
The services return information collected from public sources and the results of calculations.
Coverage has limits. It starts from when DAP first collected a source. A record can be late, incomplete or wrong. Check the original source before you rely on it.
NOT ADVICENot advice.
Nothing a service returns is investment, trading, legal, tax, compliance or regulatory advice, or a recommendation to buy, sell or hold anything.
DAP does not act as your adviser, dealer or portfolio manager. Decisions made with a service's output are yours.
NO WARRANTYAs is, as available.
To the extent the law allows, the services are provided as is and as available, without any warranty of accuracy, completeness, timeliness or availability.
PAYMENTPrice first, then payment.
Each priced call states its price before you pay. Paid calls settle in USDC on the Base network, through a third-party facilitator.
A settled payment cannot be reversed. A call a service refuses or fails to answer is not charged.
Free allowances and prices can change. Any taxes on your payment are yours.
YOUR USELawful use only.
Use the services lawfully. Do not use them if you are, or act for, a person subject to sanctions under Canadian law or any other law that applies to you.
Do not get around an allowance, a rate limit or a payment, and do not disrupt a service.
THIRD-PARTY MATERIALSource material stays with its owners.
DAP gives you no rights in third-party material. Some records carry only a title, a date and a link, so that the source remains the place to read it.
Where a service states a licence for its own data, that licence applies to that data.
LIABILITYLimitation of liability.
To the extent permitted by the laws of Ontario, the total liability of Dartmouth Advisory Partners Inc. for all claims relating to the services is limited to the amount you paid DAP for the service concerned in the 12 months before the claim arose.
To the same extent, DAP is not liable for indirect or consequential loss, lost profits, trading losses or regulatory penalties.
Nothing here limits liability that the law does not allow to be limited.
LAWGoverning law.
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. The courts in Toronto have jurisdiction.
CHANGESChanges.
We change these terms by posting a new effective date on this page. Each service's own privacy note says what it keeps. See also the website terms.
